Somerby Festival of Walking

Assumption of Inherent Risk

Somerby Festival of Walking organises free-of-charge walks led by local volunteers on public access footpaths, bridleways, tracks, lanes and roads.  Walking these routes can include muddy and slippery areas, climbing stiles and other obstacles, some of which are not in perfect repair, crossing fords and cattlegrids, walking on tracks, lanes and roads where cars and other vehicles may also be present. 

The participant acknowledges the inherent risks of walking these routes and that the Organisers of Somerby Festival of Walking and the Autumn Specials have used reasonable efforts to select routes that are not unduly risky and to draw to the participant's attention the risks that may be expected on this route. The participant understands that these risks cannot be completely eliminated but can be managed by the participant if they take reasonable care of themselves and any minors for whom they are responsible.

The participant understands that it is their own responsibility to review the walking route, details provided, length and expected walking time set out on the Somerby Festival of Walking website and to review the Terms and Conditions on the website and to make their own decision as to whether the participant is physically capable of and appropriately equipped for participating in the Somerby Festival of Walking or the Autumn Specials.  The participant acknowledges that they have paid nothing to participate, and are not relying on the advice or recommendation of any third party in deciding to participate.

The participant understands and acknowledges that if they are making a booking for other people they will make the terms of this waiver known to the others for whom they are booking and assume the inherent risk of such other people taking part in any of the Walks or Autumn Specials.

Limitation of Liability

The participant, on behalf of themselves and any minor child for whom they are responsible, hereby forever waives, releases, covenants not to make any claim or action for loss, costs expenses or damages and discharges the organisers and walk leaders of Somerby Festival of Walking and the Autumn Specials from any and all such claims arising out of the participants participation in Somerby Festival of Walking or the Autumn Specials, except to the extent that liability cannot be excluded under applicable law.

The participant hereby agrees to reimburse and indemnify the organisers and walk leaders of Somerby Festival of Walking and the Autumn Specials in respect of any claims made by the participant, their relations, heirs, next of kin or any legal or personal representatives, successors or assigns or anyone bringing a claim against the organisers and walk leaders of Somerby Festival of Walking and Autumn Specials on the participants behalf, except for claims liability for which cannot be excluded under applicable law.
